The Answer to the Question Regarding Selling in Installments with the Presence of a Penalty Clause To: Aboudhia Taki

Question

Is the selling contract legal when the selling price is fixed as a monthly payment with a written penalty clause of increasing the value of installment in case the buyer fails to pay on time or delays the payment?

Answer

The contract of selling can be set for an upfront payment and it can also be as a deferred payment i.e. installments.
But it is not permissible to increase the price due to the failure of the buyer to make the payment. If the failure of payment is by a wealthy person who is delaying; he will be punished by the state, a suit will be filed against him for delaying due to the saying of the Prophet (saw) as narrated by Abu Dawoud on the authority of Amr bin ash-Shreidi from his father from the Messenger (saw) said: «لَيُّ الْوَاجِدِ يُحِلُّ عِرْضَهُ، وَعُقُوبَتَهُ» "The delaying (in payment) by the wealthy (who is able to pay) permits the verbal attacks (to be called a delayer) on him and his punishment". And "ليّ" ‘me' means delaying, and the "الواجد" the ‘wealthy' is the one able to repay. "يحل عرضه" i.e. it is permitted to call him a procrastinator and may even chastise him and "عقوبته" to punish him which is clear.

If the reason for non-payment is due to a hard time he is facing, then he should be given respite. Allah (swt) says:

((وَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٍ))

"And if someone is in hardship, then [let there be] postponement until [a time of] ease." [Al- Baqara: 280]
He should be given the time to be able to pay.

Therefore, if the selling contract is fixed for instant cash payment or by installments then the price becomes binding on both parties. The price must not increase in the failure of making a payment as this would be Riba (interest). This form of interest was widespread during the days of ignorance (Jahiliyah). It was narrated from Ash-Shafi'i:" From the Riba of the days of ignorance, a man who lends another a loan, then he resolves the contract and says to the one in debt to pay it or to pay by riba and he delays the payment, the value of debt will increase and will delay the payment."

In conclusion the price which has been agreed upon at the beginning is binding on all parties and its value is not allowed to be increased due to failure to pay on time or to postpone payment with the increase in the price, otherwise it will be Riba.

Question

My dear Ameer and honorable Sheikh: What are the varieties of crops and fruit on which the Zakat is due? For example there are some who pay the Zakat on oil, what is the standard in that?

It is known that the Fifth (al-Khams) is due on buried treasures or treasure troves. My question is: Someone found Ottoman properties (funds of the livelihoods of soldiers). Does he then own them after paying the due Fifth or is it property of the Islamic State, to be kept in trust and returned to the Khilafah "Caliphate" State, when it is established soon, Bidhnillah?

Answer

Assalamu Alaikum wa Rahmatullahi wa Barakatahu

1. Regarding the varieties of crops and fruit on which the Zakat is due, they are: wheat, barley, dates, and raisins. They have been mentioned exclusively in the Ahadeeth, so no other agricultural produce is included. The evidence is the following:

a. Musa Bin Talha narrated from ‘Umar that he said:«إنّما سنّ رسول الله الزكاة في هذه الأربعة: الحنطة، والشعير، والتمر، والزبيب» "The Messenger of Allah (saw) taught the Zakat on these four: wheat, barley, dates, and raisins." Narrated by at-Tabaraani.

And it is also narrated from Musa Bin Talha who said:أمر رسول الله معاذ بن جبل - حين بعثه إلى اليمن - أن يأخذ الصدقة من الحنطة والشعير، والنخل، والعنب "The Messenger of Allah (saw) ordered Mu'adh Bin Jabal when he sent him to Yemen to collect the Sadaqah on wheat, barley, palms, and grapes." Narrated by Abu ‘Ubayd.

These Ahadeeth show that Zakat on crops and fruit is to be taken from these four varieties: wheat, barley, dates, and raisins. The Zakat is not to be taken from other types of crops and fruit, because the first Hadeeth came in a wording that indicates a limiting linguistic function.
b. Al-Hakim, al-Bayhaqi, and at-Tabaraani narrated the Hadeeth from Abu Musa and Mu'adh, when they were sent to Yemen by the Prophet (saw), to teach the people their Deen that he (saw) said: «لا تأخذا الصدقة إلاّ من هذه الأربعة: الشعير، والحنطة، والزبيب، والتمر» "The Sadaqah is not taken except from these four: barley, wheat, raisins, and dates."

Al-Bayhaqi said about this Hadeeth: "Its narrators are trustworthy and its narration is a chain transmission (Muttasil)."
This Hadeeth is clear in limiting the Zakah that is due on crops and fruit to these four varieties, because the word إلاّ "except/only" if preceded by a particle of negation, limits what came before it to what comes after it. Hence the Sadaqah was limited to the four varieties that were mentioned afterwards, being: barley, wheat, raisins, and dates.

c. The words "wheat, barley, dates, and raisins" which appeared in the Ahadeeth are static, thus do not carry other than their original meanings, no direct meaning (Mantuq) and no implied meaning (Mafhum), because they are not appellative nor category names. Rather they are limited to the objects which are named after them, and called by these names. Therefore such meanings as "dried fruits" or "food reserves" cannot be derived from their wording, because they do not imply these meanings or attributes. These Ahadeeth, which confined the necessity of Zakat to these four types of crops and fruit, specify the general wording that came in the Hadeeth:فيما سقت السماء العشر، وفيما سقي بغرب، أو دالية، نصف العشر "The tenth is due on what is watered from the sky, and half the tenth on what is irrigated by carried water."

This means that the tenth is due on what is watered by the sky from wheat, barley, dates, and raisins. While half the tenth is due on what has been irrigated by carried water.

d. The Zakat is not obligatory on other than these four varieties of crops and fruit. So the Zakat is not taken from corn, rice, beans, chickpeas, lentils, and other grains or cereals. It is not taken from apples, pears, peaches, apricots, pomegranates, oranges, bananas, and other types of fruit, because these grains and fruits are not covered by the words "wheat, barley, dates, and raisins". Also there is neither an authentic text that enumerates any of the aforementioned, nor is there a consensus, nor are they included through a Qiyas (analogy), because the Zakat is an act of worship, and the worships are not open to analogy in the form of Qiyas. Rather the worships are confined to the range of the text. Similar the Zakat is not taken from vegetables, such as cucumber, pumpkin, eggplant, turnips, carrots etc. It is reported from 'Umar, Ali, Mujahid, and others, that there is no Sadaqah on vegetables, as narrated by Abu ‘Ubayd, al-Bayhaqi, and others.

2. Concerning the second part of the question pertaining to treasure troves: Who finds a treasure has to pay the Fifth on it to the Islamic State, which will spend it in the interest of the Muslims. The other four-fifths belong to the one who found the treasure, unless he found it on someone else's land.

If there were no Islamic State, as is the case today, the one who finds the treasure pays the Fifth to the poor and needy and spends it in the interests of the Muslims. Thereby he frees himself from that obligation and the rest belongs to him.
The evidence for this is:

A. A treasure is money buried in the ground, either silver, or gold, or jewels, or pearls, or otherwise, like armaments or weapons; whether treasures buried by former peoples like the ancient Egyptians, Babylonians, Assyrians, Sassanids, Romans, Greeks, and others, consisting of coins, ornaments, or jewels that are found in the tombs of the kings and nobles, or in the hills of ancient rundown towns. Be it golden coins, or silver, placed in a jug, or other, hidden in the earth since the days of Jahiliyyah, or the last Islamic days. All of that is considered a treasure.
Linguistically the Arabic term for treasure "الرِكاز" is derived from "ركز، يركز", similar to the term "غرز يغرز" (to implant), describing something hidden. The saying goes: "The spear is fixed when he plants it into the ground." Also "الرِّكز" is the hidden sound. Allah Almighty said: ((أَوْ تَسْمَعُ لَهُمْ رِكْزًا)) "or hear from them a sound?" [Maryam: 98]

Whereas metal is what Allah created in the earth, upon the creation of the heavens and the earth, from gold, silver, copper, lead, and others. Linguistically "المعدن" (metal) is derived from "عَدَنَ" (perpetuate), i.e. to perpetuate in a place if you lived in it. Paradise was named after it as "جنة عدن", because it is a place of eternal stay. Hence metals are from the creation of Allah, they were not buried by humans. Therefore they carry a ruling different from treasures, since the treasure was buried by human beings.

B. The original ruling on treasure troves and metals, is what Abu Hurayrah reported from the Messenger of Allah (saw), who said: العجماءُ جرحها جُبار، وفي الركاز الخمس "The wounding of a beast requires compensation, and on the treasure the Fifth is due." Narrated by Abu ‘Ubayd.

Also what was narrated from ‘Abdullah Bin ‘Amru that the Prophet (saw) was asked about the money that is found on a desolate plain, and said: «فيه وفي الركاز الخمس» "On it and on the treasure trove the Fifth is due."

And what was narrated by ‘Ali Bin Abi Talib from the Prophet (saw), that he said: وفي السيوب الخمس. قال: والسيوب عروق الذهب والفضة  التي تحت الأرض"On the Suyub the Fifth is due. He said: The Suyub are the veins of gold and silver under the ground." Mentioned by Ibn Qudamah in Al-Maghniy.

C. Therefore, all money that is buried from gold, silver, jewelry, jewels, or other, found in graves, or in the hills, or in the cities of previous nations, or found in the land of dead, or in the desolate plain, that is relatively old, buried in the times of Jahiliyyah, or buried by Muslims in the past eras of Islam, is owned by the finder, who pays the Fifth to the State Treasury (Bayt al-Mal).

Similarly every small amount of metal, that is not worth of counting, be it gold or silver, whether in the form of veins or discharged, that was found on dead land, not owned by anyone, is the property of the finder, who pays from it the Fifth to the State Treasury (Bayt al-Mal). If the amount is worth of counting, not a limited amount buried, then it takes the rule of public ownership and has other details.

The Fifth that is taken from the finder of the treasure and the finder of the metal is paid into a department within the State Treasury, called "Diwan al-Fay' wal-Kharaaj" and is spent in the same way as al-Fay' and al-Kharaaj. They fall under the proxy of the Khaleefah who spends them in care of the affairs of the Ummah, and spends them in their interests according to his opinion and diligence, for the sake of goodness and righteousness.

D. Whoever finds a treasure or metal on his own property, either his land or his building, then it is his property, whether he bequeathed the land or the building, or bought it from others. Who finds a treasure or metal in the land or building of another, then the treasure or metal belong to the owner of that land or building.

News & Comment Study Reports that Majority of Turkish People Oppose Extramarital Relationships, while Turkey's Capitalist Liberal System Encourages it

A study by Turkish universities, Koc and Sabanci, published this week reported that 72% of those surveyed in Turkey oppose extramarital relationships, including the idea of couples living together without getting married, while 87% of Turkish people believe that couples should be married if they want to have a child. This comes in the same week that Turkish media reported on President Erdogan's criticism of cohabitation of male and female students at universities and call for more gender-segregated dormitories on campuses. He stated that mixed-gender cohabitation had caused many problems and that, "This is against our conservative and democratic values".

Comment:

Despite Islam and the Turkish people's clear opposition to relationships outside marriage, and his own statements against mixed gender cohabitation, Erdogan and his government continue to full-heartedly support and govern over a Capitalist Liberal system that celebrates the Turkish entertainment and tourist industries which actively encourage the free-mixing of men and women and extramarital relationships. This is alongside presiding over a legal framework which allows unmarried couples to live together and engage in intimate relationships outside marriage. Recently, the Turkish Deputy Prime Minister Bulent Arinc acknowledged that in Turkey individuals can decide their own living arrangements according to their own wishes, saying, "There is no legal objection or barrier to those who are over 18 years old and who want to live together in rented houses".

This capitalist liberal system has endorsed the mass production of corrupt Turkish dramas and soap operas that have relentlessly been promoted to the society as well as exported on mass to the Arab world and Indian subcontinent. These shows not only parade women in revealing, sexually provocative dress but also include vulgar, lewd and explicit ideas and scenes as well as glamourising extramarital relationships. All this contributes to the sexualisation of society as well as normalising and desensitizing the disgust towards fornication, adultery, and even having children outside marriage, all of which Islam condemns and that erodes the moral fabric of society. One Turkish columnist writes, "This isn't broadcasting, this is social engineering in immorality." It is the same immorality and social chaos that plagues Western states due to their liberal personal and sexual freedoms. It is not surprising then that in June this year, the New York Times described the exponential rise in Turkish cinema as a "triumph of Western values". However, these same values that encourage individuals to pursue their carnal desires have resulted in 9 out of 10 youth between the ages of 13 and 17 in the UK engaging in an intimate relationship (according to the children's organisation, the NSPCC) and almost 50% of children being born out of wedlock in the country (according to its Office for National Statistics). This is surely not the future that the Muslims of Turkey wish to see for their society, but one that may materialise if the liberal values and system continues to rule their state. Furthermore, corrupt Hollywood notions of love and romance in the Turkish entertainment industry have generated erroneous, unrealistic, and unIslamic expectations of what to look for in a spouse and marriage, causing some to seek Western perspectives of beauty and qualities in fictitious characters of soap operas in their own husband or wife. Failure to match up has led to individuals looking elsewhere to fulfil those deceptive expectations, resulting in adultery and divorce. Perhaps it is not surprising therefore that the divorce rate in Turkey over the last 10 years has increased by 30%.

However, despite all this, the capitalist Turkish government has actively promoted and financially supported the Turkish drama and cinema industry for the sake of profit and revenue. According to the UK Guardian paper, just a decade ago the international sale of Turkish TV dramas amounted to less than $1 million but by 2010 it had reached $50 million. In addition, the rise in tourism to the country has been attributed in large part to these shows as stated by Turkish Culture and Tourism Minister Ertugrul Gunay at a ceremony in Turkey this January, that presented tourism awards to producers and actors of Turkey's TV dramas. He said, "Turkey gets nearly $25 billion in income from tourism....the most effective promotion is that of culture and arts...This is the result of our synergy." He also mentioned that the state had given around 110 million liras of support to Turkish cinema since 2006. Therefore, as with all capitalist regimes, the Turkish government has demonstrated its open willingness to ignore and discard morality, principles, and the social wellbeing of its people for the sake of financial gain, and that all talk of preserving the moral fabric of society is nothing but lip service.

We call the Muslims of Turkey to reject the decadent capitalist liberal system which currently pollutes your land and stands in stark contrast with your noble Islamic values. Replace it with the Khilafah "Caliphate" state which truly embodies and will implement your deeply held Islamic beliefs and principles. Through its full application of the Shariah, it will protect our Muslim society from the influx of the debased Western liberal culture, and implement the Islamic social system which effectively regulates the relationship between men and women, minimizing extramarital relationships. This is alongside promoting the pure Islamic values and morals within the state through its education system and media, and enforcing harsh punishments for fornication and adultery. So rather than settling for the empty rhetoric of politicians, call for the Khilafah "Caliphate" which will return the sublime principles of your deen to your land.

Press Release Pertaining to the Regime Starting the Central Aleppo Prison Massacre Oh Muslims: The Sidnaya Prison Massacre was one of the causes of Revolution in al-Sham, and now the Central Aleppo Prison Massacre must be a Direct Cause for the Eradicat

The protocols of the encounters in London, Paris, New York, Moscow and Istanbul for the sake of what is called a political solution were still beginning, when the regime intensified its attack on the people of Syria and doubled the blood baths on every area of this pure land, the land of the Prophets, Companions and noble Followers. After the massacre of Safira and the blockade of the Damascus suburbs, Homs and Hama, Bashar and his cursed clan premeditated to carry out a horrific massacre in the Central Aleppo Prison. He instructed his demons there to shoot the innocent prisoners, who out of fear barricaded themselves in their cells with everything they could find, and they shot these heroes with RPG's. They shelled innocent people, who held no weapons, not even a knife, with this anti-tank weapon. Two heros were martyred, among them the martyrs, Allah willing, Abu Ja'far Umar Uthman, and another was hit with three bullets in his legs that hemorrhaged alongside the other injured who have no hope of surviving unless their brothers became their victors and charged to the Central Aleppo Prison, and end the tyranny of Bashar's villains, the soldiers of this century's Pharoah and his Namrood.

The news that reached us, confirmed attached with photographs, proves this truth that shames the face of humanity, and shows the extent of the hatred of what is called the international community for the Muslims in Syria; because they refused to be subservient to America and declared their revolution for Allah, and stood strong in the face of America's agent Bashar and America's other agents in the region who the revolution of al-Sham exposed, starting with Iran and its Hezb in Lebanon to its Maliki in Iraq to Turkey's Erdogan to America's slaves among the rest of the Arabs and Muslims, may Allah not bless them or be good to them, and may Allah curse the oppressors.

Oh Revolutionaries, Protectors of the Revolution of al-Sham and Allah's Deen:

You know that there is a faction who relied on those who have wronged and gave the benefit of doubt to those who met with the Minister of Qatar, and those who have met with ambassadors and delegates of the West, and those who urge the step of meeting with the Ambassador of the State of death and destruction, Robert Ford, who is coming to Turkey to ‘placate' you. So what have they gained? And what has the Revolution of al-Sham reaped from their reliance on them? Do they not read the saying of Allah subhannahu:

((وَلَا تَرْكَنُوا إِلَى الَّذِينَ ظَلَمُوا فَتَمَسَّكُمُ النَّارُ وَمَا لَكُمْ مِنْ دُونِ اللَّهِ مِنْ أَوْلِيَاءَ ثُمَّ لَا تُنْصَرُون))

"And do not incline towards those who do wrong, or the Fire may touch you; and you will have no protectors besides God, and you will not be saved." [Hud: 113]

But we here among you salute those who refused this world for their Deen, and rejected the Coalition and its people and refused to bow down to Geneva 1 and 2, and insisted on the Islamic nature of the revolution and the demand for the Islamic Khilafah "Caliphate" for the future Syria. They have from us and all the Muslims who are sincere to Allah (swt) and His Messenger (saw) all respect and esteem, and we pray for them to be steadfast and that Allah's satisfaction be on them in this life and the Hereafter, and that they drink from the basin of al-Mustafa a blessed and quenching drink after which they will never thirst; they and those who save the sons of the Muslims from the prison of Aleppo and set them free from the clutch of the enemies of Allah (swt) and the enemies of the Deen.

Press Release By the Praise of Allah, the Oratorical Festival was Concluded "Be the Ansar of Allah"

By the praise of Allah, the Speeches Festival organized by Hizb ut Tahrir / Wilayah of Jordan in Southern Mazaar in the city of Karak which was entitled "Be the Ansar of Allah". It witnessed a large turnout from the sons of the Muslims that included notables, activists, and political activists.

The Festival commenced with the recitation of verses from the noble Qur'an, followed by a welcoming speech by Brother Yusuf Al-Qatwani, one of the notables of Mazaar and the city of Karak. This was followed by a speech delivered by Captain Waheed Al Battoush; he expressed the need of the Ummah for the Khilafah "Caliphate" State. Dr. Adnan Ash-Shamry delivered the speech of Ma'an city in this Festival; he reminded of the revolution of Ash-Sham that marched out of the mosques calling for the Islamic Khilafah "Caliphate" and how that all the countries of the world are conspiring against this blessed revolution. The speech of the city of Tafilah was delivered by Brother Ahmad As-Sahreen; he said that it is incumbent upon the activists in the Muslim World to adopt a clear vision to bring the change based on Islam alone; he condemned the adoption of the vision from man made ideologies like capitalism and democracy by the Muslims.

Brother Mamdouh Qitaishat, the head of the Media Office of Hizb ut Tahrir / Wilayah of Jordan, delivered a speech calling the Muslims to be the supporters of Allah (swt) and His Deen; elaborating that the problems of Jordan will not be solved except by the return of the Deen as it was in origin in Bilad ash-Sham under the Islamic Khilafah "Caliphate" State. The Festival was concluded with the speech of Brother and Sheikh Sa'eed Al'Awadah (Abu Immad); he thanked the men of Karak for attending and interacting in the Festival, describing the land of Karak as the land of the pure ones.
Following this immense blessing from Allah upon us in Southern Mazaar in the city of Karak, Hizb ut Tahrir/ Wilayah of Jordan would like to direct its sincere appreciation to all those who supported, aided and signed the welcoming document of our Festival and we ask Allah Azza wa Jal to reward them with the best of rewards and prescribes this for them in their book of deeds.

Al-Arabiya TV channel reported, quoting AFP, today Saturday that the Syrian Opposition National Coalition is awaiting an official invitation from the United Nations to attend the Geneva 2 conference, stressing that "the United Nations is the sole sponsor" for this conference. Khaled Saleh, the spokesman for the Coalition said in a press conference from the city of Istanbul, "We are ready to engage in any political process to achieve the demands of the Syrian people".
