Supporting the Two-State Solution: A Betrayal of Islam and Palestine

News:

The recent interview of the Malaysian Prime Minister (PMX) with CNN has sparked outrage among Muslims in Malaysia. During the interview, PMX acknowledged that the Zionist entity has a 'right' to the land of Palestine, albeit de facto, and claimed that they have the right to defend themselves. This statement comes as no surprise, as Malaysia has long supported the two-state solution—a framework that recognizes the coexistence of an ‘Israeli’ and Palestinian state.

Comment:

Palestine was liberated by Muslims through jihad under the leadership of Caliph Umar al-Khattab in 637 CE. The siege led by Khalid al-Walid compelled the people of Aelia (Palestine) to surrender and sign a peace treaty with Caliph Umar Al Khattab. From then on, Palestine became an Islamic territory, governed by Islamic law.

In Islamic jurisprudence, Palestine is classified as Kharajiyah land, which is owned by the Baitul Mal. The inhabitants have the right to cultivate and utilize the land, but they are required to pay an annual kharaj tax, which is a right of all Muslims. This tax applies to lands obtained through war or peace treaties. Allah (swt) states:

[مَّا أَفَاء اللَّهُ عَلَى رَسُولِهِ مِنْ أَهْلِ الْقُرَى فَلِلَّهِ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ كَيْ لَا يَكُونَ دُولَةً بَيْنَ الْأَغْنِيَاء مِنكُمْ]

“Whatever gains Allah has given to His Messenger from the inhabitants of the towns belongs to Allah, the Messenger, the Messenger’s kin, orphans, the poor, and travelers. This is so that wealth will not merely circulate among the rich among you.” [Surah Al-Hashr (59): 7]

Caliph Umar used this verse to justify his decision not to distribute the Kharajiyah lands of Iraq, Sham, Egypt, and Palestine to the Muslim army but to preserve them as fai (state property) for the benefit of all Muslims.

Sharia firmly establishes that Kharajiyah land remains the property of the Muslim Ummah until the Day of Judgment. This principle was also upheld by Caliph Abdul Hamid II, who refused to sell even an inch of Palestine to the Zionists, recognizing its sacred status as part of the Islamic legacy.

Any recognition of non-Muslim ownership of Palestinian land is a direct violation of Sharia. Supporting the two-state solution, which legitimizes Zionist occupation, amounts to betrayal of the rights of the Muslim Ummah. Such an act is not only a political misstep but also a transgression of fundamental Islamic principles.

Muslims must reject any framework that legitimizes the occupation of Palestine. The land of Palestine is an inalienable trust of the Muslim Ummah, and it is our duty to safeguard it. To agree to the two-state solution is to turn a blind eye to this sacred obligation and to betray the trust bestowed upon us by Allah (swt). Palestine will remain a part of the Islamic legacy, and it is incumbent upon Muslims to strive for its liberation until the end of time.
