Guantanamo Demonstrates a Defining Weakness of Democracy

  • Published in News & Comment
  •   |

Event:

Today's article in the Guardian Newspaper, 25th June, 2013, entitled: "Force-feeding Guantánamo detainees is unethical and inhumane" is one of a string of recent reports and commentaries about the brutal mistreatment and torture of Muslim prisoners in the notorious Guantánamo prison camp. The majority of the prison population are on hunger strike, 104 out of 166 prisoners as of Monday 24th June, according to an article by Charlie Savage in the New York Times who argues for transferring the prisoners to the U.S. mainland as a possible solution.

The New England Journal of Medicine published a perspective piece on the 13th June with the title: ‘Guantánamo Bay: A Medical Ethics-Free Zone?" that opposed the current "violation of medical ethics" by medical professionals under military jurisdiction and argued that a hunger striker's goal is "not to die but to have perceived injustices addressed". Likewise, a major British medical journal, The Lancet, launched a petition against the abuses in Guantánamo prison.

The Guardian Newspaper from Britain has been following the case of Shaker Aamer who is the last British remaining resident of the camp who has described the use of "freezing cold" conditions in cells and the use of "metal tipped" feeding tubes to make life as painful as possible for the prisoners. Other articles have focused on the use of psychological torture as well as degrading practices to make prisoners stop their protest.

Comment:

The media have clearly exposed the inhumane conditions, the torture, the degradation and the moral and legal ambiguities of the U.S. run prison in Guantánamo Bay, but two additional points are worth adding.

First, this ongoing story is not only about a single prison or a single government policy, rather it says something fundamental about the U.S. culture and the democracy that it sings about to the world. Situated on a military base in Cuba to quietly insulate it from legal intervention or ethical norms, Guantánamo has become a moral black hole for the U.S. whose democratically elected governments, headed first by Bush and now by Obama, have each demonstrated a defining weakness of  democracy.  In the face of an ideological challenge from a morally assertive opponent, democracy cannot uphold or adhere to its own values in a distinguished manner. Democracy surrenders to ‘dictatorship' and ‘demagoguery', today, as it did in ancient Rome and Athens, when faced with a challenge.

Despite its military might the U.S. has felt weak and unable to protect its interests and its democracy without grossly violating all the fundamental principles and rights of man that it hypocritically claims are ‘universal'. Hence, the systematic torture and abuse, despite the fact that these have been exposed for all the world to see.

Second, ethics and law are fragmented: there is military law and civil law, medical ethics and general morality. This is another weakness of the West and its patchwork culture, and this has left medical practitioners serving in the U.S. military torn between two masters.

It comes as no surprise then that the Muslims who are suffering abuse in Guantánamo Bay were such an inspiration of moral ascendancy that one of the former U.S. prison guards, Terry Holdbrooks, embraced Islam himself when he saw the certainty and dignity of their faith.

Woolwich: Challenging the Government's Blame on Islamic Institutions and Mosques

  • Published in Media Coverage
  •   |

Now, nearly every day, there is a new attack on a Mosque, Islamic school or Muslim individual as a result of the killing in Woolwich, London. This has generated a lot of anxiety amongst Muslims and is stoking tension between communities.

The Muswell Hill Islamic Centre was burnt down and many Mosques have been attacked because some people are falling for the lie that Mosques, Madrasahs and Islamic societies are somehow responsible for the Woolwich killing.

After Woolwich, there is heightened tension, anger and questions. Instead of genuinely addressing the causes of that event - some hate preachers saw it as an opportunity to further their agenda.

Prime Minster Cameron spoke in parliament and told the country that Mosques and some Islamic institutions are somehow responsible. He failed to bring one example of a Mosque that says it is OK to kill someone on the streets of Britain.  Tony Blair - dripping with the blood of countless Iraqis - came out and said, "There is a problem within Islam," and Mayor of London, Boris Johnson, wrote in the Telegraph that believing in basic Islamic concepts; Shariah, Khilafah "Caliphate", Jihad and Ummah are what lead to Woolwich.

The anti-Muslim group, the English Defence League (EDL) has also organised demonstrations in various parts of the country chanting anti-Muslims slogans. This has lead to Muslims feeling intimidated in various areas. While the EDL's anti-Muslim rants may be dismissed by some - because many of them are seen as thugs - the statements of Blair, Cameron and Johnson are far more potent in poisoning the minds of our non-Muslim neighbours and colleagues. Some of the politicians and the EDL are united in preaching the same message that ‘Islam is the problem' that lead to the Woolwich killing.

Weeks before the July 2005 London bombings, the government's Joint Terrorism Analysis Committee warned it that its invasion of Iraq would serve "... as motivation and a focus of a range of terrorist related activity in the U.K." Yet this government, and the one before it try to hide the uncomfortable fact that its occupations and use of drones are fundamental factors generating the anger that someone then reacted to. Despite that fact, the government seeks to put the blame and focus for Woolwich - solely on the Muslim community. This allows it to shut down debate about its colonial foreign policy. This allows it to state that the subsequent measures must be directed at Islamic institutions.

((أَحَسِبَ النَّاسُ أَن يُتْرَكُوا أَن يَقُولُوا آمَنَّا وَهُمْ لَا يُفْتَنُونَ))

"Do people think that they will be left alone because they say: "We believe," and will not be tested." [Al-Ankabut 29:2]

In Surah Ankabut, Allah (swt) reminds us that life is a test. In these testing times, we have to be the responsible ones. We have to act Islamically. That means we do not go out stoking tension. That means making sure that Muslims know how to channel the anger generated by the UK government's foreign policy. That means constantly challenging the government's lies the Islamic institutions are somehow responsible for Woolwich.

Our neighbours, colleagues and co-workers are not the government. They are the people whose minds the government is attempting to poison - so we must challenge the poisonous narrative they are being fed. How?

1)    In discussions, point out the fallacy of the government's arguments that its Islam, not its foreign policy

2)    Call in to radio stations like BBC 5 Live or LBC when they discuss Islam and Woolwich

3)    Write to newspapers and comment on articles peddling the government's false narrative

4)    Invite non-Muslims to Mosque Open days so they see what really goes on in such places

We have to challenge the government's narrative. We have to challenge the preachers of hate. We have to engage with the wider public and explain Islam to them.

Central Media Office: Report on Women's Participation in Khilafah Conferences in Palestine Activities of the Shababat Hizb ut Tahrir in Palestine on the 92nd Hijri Anniversary of the Destruction of the Khilafah

  • Published in Video
  •   |

To commemorate the 92nd anniversary of the destruction of the Khilafah "Caliphate" and the re-awakening of the Ummah to work to re-esatablish what has been destroyed and the outcome of the Islamic Ummah after its loss. The Shabab of  Hizb ut Tahrir in Palestine conducted activities and events throughout different areas, which included seminars, lectures, and rallies that addressed the current conflicts in the international community and the conspiracies being hatched against the establishment of the Khilafah "Caliphate" State especially with the Syrian Revolution. This is a sign that victory is soon, Inshallah.

The current Ameer, the eminent scholar Ata Bin Khalil Abu Al-Rashtah (may Allah (swt) protect him) highlighted in a voice recording the revolutions especially the Syrian Revolution including the Hizb's work especially its activities in the dawah work worldwide. It showed the state of Muslim men and women in Burma, Chechnya, Turkistan, Syria, Afghanistan, and elsewhere without the Khilafah "Caliphate" to remove these injustices committed and to defend  women's dignity.

The number of attendees that attended the activities, conferences, or seminars ranging from different ages to groups all call for relief, victory, and strength by calling for the establishment of the Khilafah "Caliphate" State soon, Inshallah. Women participated in the conferences that were held in Hebron and Jenin, which thousands attended, including speeches given by our sisters in both conferences. They also rallied in the demonstration that was launched in Gaza.

This shows the crucial role women play in the Dawah work not as how the West portrays that she is oppressed or has an absent role, but works side by side with men to implement Allah's Shariah to be implemented in order to gain Allah's pleasure in this world and the Hereafter.

We ask Allah to hasten our success in order to return the real status for women: their dignity, and pride.

Same-Sex Marriage: US Supreme Court Gives Gay Marriage Historic Boost:

For gay rights, the Supreme Court gave the nation's legally married gay couples equal federal footing with all other married Americans on Wednesday and also cleared the way for same-sex marriages to resume in California. Gay-rights supporters cheered and hugged outside the court. Opponents said they mourned the rulings and vowed to keep up their fight. In the first of the narrow rulings in its final session of the term, the court wiped away part of a federal anti-gay marriage law, the Defense of Marriage Act that has kept legally married same-sex couples from receiving tax, health and pension benefits that are otherwise available to married couples. Justice Anthony Kennedy, joined by the four liberal justices, said the purpose of the law was to impose a disadvantage and "a stigma upon all who enter into same-sex marriages made lawful by the unquestioned authority of the states." President Barack Obama praised the court's ruling against the federal marriage act, labeling the law "discrimination enshrined in law." "It treated loving, committed gay and lesbian couples as a separate and lesser class of people," Obama said in a statement. "The Supreme Court has righted that wrong, and our country is better off for it." (Source: Associated Press)

Activists say Syrian Death Toll Tops 100,000:

Syrian activists say more than 100,000 people have been killed since the uprising against President Bashar al-Assad began in March 2011. The British-based Syrian Observatory for Human Rights announced its latest count Wednesday, saying the figure included 18,000 rebels and about 40,000 pro-Assad fighters. The United Nations said earlier this month nearly 93,000 people were confirmed dead, but that the actual number is probably much higher. (Source: Voice of America)

Afghan Revelations: Pakistan-US Secret Diplomacy Created Doha Roadmap:

Months-long painstaking and secret negotiations involving Islamabad and Washington have yielded a detailed roadmap for steering negotiations with the Afghan Taliban which will start to unfold with the release of five Afghan prisoners from Guantanamo Bay and the return of the captured US soldier PFC Bowe Bergdahl, at present in Taliban custody. While the opening of the Taliban office in Doha, Qatar, has captured headlines across the world, wide-ranging interviews with highly-placed diplomatic, military and foreign office sources reveal that this office is but one of the many elements of a complex process, the ultimate aim of which is for all stakeholders in Afghanistan to share power through an inclusive election process under a possibly modified Afghanistan constitution. "The journey begins now and if all goes well should co-terminate with the exit of the American combat troops and holding of elections in Afghanistan that brings everyone onboard," says a diplomatic source who has been involved in this process. Other elements of this process are complete reconciliation with the Taliban led by Mullah Mohammed Omar, multiple-level dialogue between the Taliban and non- Pashtoon groups, agreement on the constitutional framework to govern Afghanistan after safe and trouble-free exit of the US forces from the Afghan soil, gradual cessation of kinetic operations and crucially, dispensing with Hamid Karzai in the political sense in case he tries to subvert peace efforts. There is little doubt in anyone's mind that this road is slippery and with no guaranteed success. However, a near-complete and rare alignment of views between the US administration and Pakistan's policymakers achieved through a robust and out-of-media-glare talks has created space for ‘pulling this one off', says the source. "There has been some direct dialling between Pakistan and John Kerry, the US Secretary of State, working under clear guidelines from president Obama," says one of Pakistan's top negotiators.(Source: The Express Tribune)

Myanmar Gives Official Blessing to Anti-Muslim Monks:

The Buddhist extremist movement in Myanmar, known as 969, portrays itself as a grassroots creed. Its chief proponent, a monk named Wirathu, was once jailed by the former military junta for anti-Muslim violence and once called himself the "Burmese bin Laden." But a Reuters examination traces 969's origins to an official in the dictatorship that once ran Myanmar, and which is the direct predecessor of today's reformist government. The 969 movement now enjoys support from senior government officials, establishment monks and even some members of the opposition National League for Democracy (NLD), the political party of Nobel peace laureate Aung San Suu Kyi. Wirathu urges Buddhists to boycott Muslim shops and shun interfaith marriages. He calls mosques "enemy bases." Among his admirers: Myanmar's Minister of Religious Affairs."Wirathu's sermons are about promoting love and understanding between religions," Sann Sint, minister of religious affairs, told Reuters in his first interview with the international media. "It is impossible he is inciting religious violence." Sann Sint, a former lieutenant general in Myanmar's army, also sees nothing wrong with the boycott of Muslim businesses being led by the 969 monks. "We are now practicing market economics," he said. "Nobody can stop that. It is up to the consumers." President Thein Sein is signaling a benign view of 969, too. His office declined to comment for this story. But in response to growing controversy over the movement, it issued a statement Sunday, saying 969 "is just a symbol of peace" and Wirathu is "a son of Lord Buddha." Wirathu and other monks have been closely linked to the sectarian violence spreading across Myanmar, formerly known as Burma. Anti-Muslim unrest simmered under the junta that ran the country for nearly half a century. But the worst fighting has occurred since the quasi-civilian government took power in March 2011.(Source: Reuters)

The Answer to the Question: The seeking of the Nusrah (support to establish the rule) To Okab Alhak

  • Published in Q&A
  •   |

Question:

Assalamu Alaikum,

It is mentioned in the book, Structuring of a Party (At-Takattul), about the reaching of the rule by way of the Ummah and the actions associated with seeking the Nusrah. Is seeking Nusrah part of the interaction stage or is it from the stage of reaching the rule? Please clarify and provide detail as before.

Answer:

Wa Alaikumus Salaam Wa Rahamatullahi wa Barakaatuhu,

Seeking the support to change the rule (Talab An-Nusrah) occurs at the end of the interaction stage. Thus if the people of power respond positively and they are capable of effecting change, then the third stage would have arrived by the permission of Allah. And we have detailed this issue in our books and in particular ‘Al-Minhaj'. Here are a few clarifying points for you:

1.    The Messenger of Allah (saw) began seeking the Nusrah during the interaction stage. When Abu Taalib died, the Makkan society was stationary and closed to the Messenger of Allah (saw). After the death of Abu Taalib the harm of the Quraish against the Messenger of Allah (saw) became more severe in a manner that they were not able to do whilst his uncle Abu Taalib was still alive. As such the protection afforded to the Messenger (saw) was weaker than it had been in the days of Abu Taalib. So Allah (swt) revealed that he should present himself to the Arab tribes to request their protection and Nusrah so that he would be able to convey from Allah that which he had been sent while he was secured and protected. Ibn Katheer has related in his Seerah from ‘Ali Bin Abi Taalib (ra) that he said: "When Allah commanded His Messenger to present himself to the Arab tribes, he went out with me and Abu Bakr to Mina until we came across a council from amongst the Arab gatherings." Ibn Katheer also related from Ibn ‘Abbass from Al-Abbass (rah) that he said: The Messenger of Allah (saw) said:

لا أرى لي عندك ولا عند أخـيك مَنَعَة، فهل أنت مخـرجي إلى السوق غداً حتى نقرّ في منازل قبائل النـاس

-وكانت مجمع العرب- قال: فقلت هذه كِنْدَة وَلَفُّها، وهي أفضل من يَحُجُّ من اليمن، وهذه منازل بكر بن وائل،

وهذه منازل بني عامر بن صعصعة، فاختر لنفسك، قال: فبدأ بكندة فأتاهم

"I do not find that I have prevention (i.e. the power of protection) in you and your brother, so are you going out to the market tomorrow with me so that we can spend time in the abodes of the tribes of the people... He said: So I (Al-Abbaas) said: This is Kindah and they are the best from those who have to come for the Hajj from Yemen, and these are the dwellings of Bakr Bin Waa'il, and these are the houses, and these are the dwellings of Bani ‘Aamir Bin Sa'sa'ah. So you choose which one to go to. He (Al-Abbaas) said: So he began with Kindah and went to them."

2.    From that time, it was clear to the people of power from the tribes that the Messenger of Allah (saw) was requesting their Nusrah. It was clear to them that what was being requested was that they protect the Messenger (saw) and that they make his foothold firm by establishing an entity amongst them that implements the rules of Allah (swt) i.e. they understood explicitly and clearly that the Nusrah was for purpose of the establishment of a State that rules and performs Jihad... It is for this reason that Banu Aamir Bin Sa'sa'ah said to him when the Messenger (saw) requested their Nusrah:

"What is your opinion if we were to give you the Bayah (pledge) upon your matter and then Allah grants you dominance over those who oppose you, will the matter (rule) fall in our hands after you?" He (saw) replied: "The matter belongs to Allah and He places it where he wishes to." So they said: Do you expect us to incur the vengeance of the Arabs and then when Allah makes you prevail then the authority will be in other than our hands? We have no need in your matter. And so they rejected him (saw)."

Hence they knew and understood that the Nusrah was the establishment of the State and they coveted to be its rulers after the death of the Messenger of Allah (saw). Similarly Banu Shaibaan said to the Messenger (saw) when he asked for their Nusrah,

"We have influence upon the two waters." The Messenger asked them about this and they said: ‘The rivers of Persia and the waters of the Arabs but we have a covenant between us and the Persians stating that we will not do anything against them or host anyone who will. And I view that this matter that you are calling to is a matter that which displease the kings. So if you would like for us to give you shelter and Nusrah in regards to the Arabs then we are at your service'. So the Messenger of Allah (saw) said: "You have not done wrong in your reply when you expressed yourselves honestly. However the Deen of Allah is not given support except by those who encompass it from all of its aspects (i.e. without conditions)." So they also understood that the Nusrah means ruling and Jihad against the Arabs and the non-Arabs. So they agreed to fight against the Arabs whilst they did not agree to fight the Persians.

3. Then when Allah (swt) decided the matter the second pledge (Bayah) of Aqabah came which represented the Nusrah for the establishment of the Islamic State in Al-Madinah. After that the third stage began which was the establishment of the State.

4. And it is clear from all of this that the seeking (requesting) of the Nusrah was before the third stage i.e. it took place in the interaction stage.

5. This is what the Hizb did when it began the work of seeking the Nusrah in the 1960's during the last century and still continues. And we ask Allah (swt) to honour this Ummah with the recurrence of the example of the first Ansaar to establish the Islamic State, the rightly guided Khilafah "Caliphate" and so that the Rayah of the ‘Uqaab, the Rayaah of the Messenger of Allah (saw) is hoisted high. And on that day the believers will rejoice with the victory from Allah.

Your brother,

Ata Bin Khalil Abu Al-Rashtah
